General Terms and Conditions
1. General Provisions
IC Health Management AG, located at Seestrasse 34c, 8806 Bäch, offers services and products, including the Vitalizer Luxury (a health and regeneration system), and provides delivery and installation.
These general terms and conditions form the basis for all business transactions and orders between IC Health Management AG and its customers.
2. Orders and Acknowledgment
By placing an order (via the online shop, email, signed purchase agreement, phone, etc.), the buyer acknowledges and accepts all provisions of these sales and delivery conditions. Any counter-conditions from the buyer will not be accepted.
3. Prices, Images, and Measurements
All prices, weights, measurements, and images in brochures, price lists, or on the website are non-binding. Model changes may occur, and product descriptions, specifications, and prices can be adjusted at any time. Products without listed prices or marked as “CHF 0.00” are available upon request.
Products and prices in the online shop represent an offer but are subject to availability or potential pricing errors. Contracts formed under these conditions will be automatically void if errors are identified.
4. VAT
Swiss VAT at the standard rate of 8.1% is included in prices and itemized on invoices.
5. Delivery and Acceptance
Delivery is conducted as promptly as possible, but specific delivery dates are not guaranteed. Orders processed via prepayment will only begin production or shipment after payment is received. Delivery locations must accommodate 3.5-ton trucks, and any additional transportation costs (e.g., cable cars or elevators) are the buyer’s responsibility.
Should delivery fail due to the customer’s fault, IC Health Management AG may terminate the contract. If the customer does not provide the necessary resources or infrastructure for delivery at the agreed time, IC Health Management AG reserves the right to store the goods at the customer’s expense until the issue is resolved.
5.1 International Deliveries
Deliveries outside Switzerland and Liechtenstein require a separate agreement.
6. Payment Terms
Payments must be made via bank transfer in advance.
7. Retention of Title
Ownership of goods remains with IC Health Management AG until full payment is received.
8. Complaints
Complaints about product quality, quantity, or incorrect delivery must be reported within 3 days of receipt. Goods are deemed accepted if no complaint is lodged within this period. Returns of defective items must be in their original packaging.
9. Warranty
IC Health Management AG offers a 2-year warranty on materials and workmanship. Warranty claims are void if the product is misused, altered, or repaired by the buyer or third parties.
10. Return Policy
Returns are generally not permitted unless due to material or manufacturing defects. Customers should contact IC Health Management AG immediately to arrange replacements.
11. Changes
IC Health Management AG reserves the right to modify these terms and conditions at any time, with updates published on the Vitalizer Luxury website.
12. Copyright
All images and text from brochures and catalogs are protected and cannot be used without written permission.
13. Jurisdiction and Governing Law
The applicable court for customer claims is determined by the residence or business location of either party. For claims by IC Health Management AG, the jurisdiction is 8806 Bäch. Contracts are governed by Swiss law, excluding the UN Convention on Contracts for the International Sale of Goods.
Invalidity of any clause does not affect the validity of the remaining terms.
